Privacy policy - website and online applications

Bjièn bv processes personal data via its website and online applications in compliance with this privacy statement. We value your privacy and want to protect the data we process by using and adhering to this policy. If a new version of this privacy policy is published, the old one will be superseded.

We take your privacy very seriously and handle your data as we would want our own data to be processed by other companies. Therefore, we take all appropriate measures to protect your personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Processing purposes

Bjièn bv collects and processes via its website and online applications based upon these grounds of processing:

  • Prospects and customers’ personal data for prospection, customer and retention management purposes including customer administration, tracking orders/agreements, invoicing, solvency monitoring, profiling and sending marketing and personalised advertising.
  • If you give us your business card, we see this as consent, but we will only use it for the intended purpose.
  • Posting comments on articles will be processed through consent.
  • Meeting slots booked are processed on a consent basis.
  • All other processing activities are based on consent unless stated otherwise.

In agreement with GDPR, 2016/679, regulations, this document serves as a guideline to inform you of your rights and how your data is used.

Processing activities

Website

Through the general contact forms on the website (via Netlify), we process your:

  • name,
  • company,
  • company address (street, number, postal code, city, country),
  • professional email address,
  • professional phone number,
  • function title,
  • messages.

We store this data for as long as the request is relevant and it will be deleted as soon as it is no longer relevant. If you would prefer to have this data deleted sooner, you can contact us as described in this policy.

Booking meeting slots

Through Calendly, we process your:

  • name,
  • professional email address,
  • professional phone number,
  • company,
  • subject of meeting,
  • timeslot,
  • additional information related to the meeting.

We store this data for as long as the request is relevant and it will be deleted as soon as it is no longer relevant. If you would prefer to have this data deleted sooner, you can contact us as described in this policy.

Business cards

If you gave us your business card, we have put the following information in our CRM (Notion):

  • name,
  • company,
  • company address (street, number, postal code, city, country),
  • professional email address,
  • professional phone number,
  • function title,
  • where we met you and your company,
  • messages.

This data remains in our CRM for two years after our last contact. The physical card is destroyed as soon as this information is entered into our CRM. If you would prefer to have this data deleted sooner, you can contact us as described in this policy.

Articles

When you subscribe to stay up to date about new articles or comment on them, we’ll process your:

  • name,
  • email address.

We need this data to contact you as soon as new articles are published. When you subscribe, you will receive an email notification. We keep your data until you unsubscribe. You can unsubscribe by clicking the link in the email or by contacting us as stated in this policy.

Webinars

When you subscribe for one of our webinars through WebinarGeek, Google Forms or ActiveCampaign, we’ll process your:

  • name,
  • company,
  • professional email address,
  • function title,
  • what webinar you attended,
  • messages,
  • opt-in for which information you would like to receive,
  • additional information related to the webinar.

We need this data to contact you regarding practical matters for the webinar (e.g., the access link, reminders). We store this data for as long as the request is relevant and it will be deleted as soon as it is no longer relevant. If you would prefer to have this data deleted sooner, you can contact us as described in this policy.

Workshops

When you register for a workshop via Google Forms or ActiveCampaign, we process your:

  • name,
  • company,
  • company address (street, number, postal code, city, country),
  • professional email address,
  • professional phone number,
  • function title,
  • billing email address,
  • dietary requirements or food allergies,
  • suggestions or additional wishes related to inclusion,
  • which workshop you participated in,
  • messages,
  • all information related to prospecting and agreements.
  • opt-in for which information you wish to receive,
  • opt-in for which information you wish to receive from our partner(s),
  • opt-in for sharing your personal data with other participants,
  • additional information related to the workshop.

We need this data to contact you regarding practical matters for the workshop (e.g., additional required information, changes, handouts, reminders). We store this data for as long as the request is relevant and it will be deleted as soon as it is no longer relevant. If you would prefer to have this data deleted sooner, you can contact us as described in this policy.

Mailing list

When you subscribe to our mailing list via Google Forms or ActiveCampaign, we process your:

  • name,

  • job title,
  • professional email address,
  • professional telephone number,

  • opt-in for which information you would like to receive,
  • additional information related to the request/download of the resources,
  • all information related to email preferences.

In this case, Bjièn acts as the data controller. This data is necessary to contact you about the information for which you have given consent. When you subscribe, you will receive an email notification. We keep your data until you unsubscribe. Downloads or requests of resources

When you submit a request for or want to download our resources through ActiveCampaign Forms on our website, we process your:

  • name,
  • company,
  • job title,
  • professional email address,
  • professional phone number,
  • messages,
  • opt-in for which information you would like to receive,
  • additional information related to the request/download of the resources,
  • all information related to mail preferences.

We need this data to contact you regarding practical matters for the download/request of the resources (e.g., the download link, updates, and new releases). We store this data for as long as the request is relevant and it will be deleted as soon as it is no longer relevant. If you would prefer to have this data deleted sooner, you can contact us as described in this policy.

For anyone who also opts in to our mailing list, Bjièn acts as the data controller. This data is necessary to contact you about the information for which you have given consent. When you subscribe, you will receive an email notification. We keep your data until you unsubscribe. Questionnaires or feedback forms

When you fill out one of our questionnaires or feedback forms via Google Forms, ActiveCampaign, or others, we process your:

  • name,
  • company,
  • professional email address,
  • professional phone number,
  • messages and answers,
  • opt-in for which information you would like to receive,
  • opt-in for further research you would like to participate in,
  • all information related to the questionnaire or feedback form.

In this case, Bjièn acts as the data controller. This data is necessary to contact you about the information for which you have given consent or further research in which you wish to participate. When you subscribe, you will receive an email notification. We keep your data until you unsubscribe. You can unsubscribe by clicking the link in the email or by contacting us as stated in this policy.

Customers and services-related

Bjièn collects and processes the data below from (representatives, appointees, or employees of) Bjièn’s clients:

  • Identification data: name, first name, (professional) email address, (professional) phone number, job title, LinkedIn profile hyperlink.
  • Company data: legal form, name, company number, address of the registered office, (professional) phone number, and (professional) email address.
  • Information on where and how we met you.
  • Participation history (regarding the workshops).
  • Health data: dietary requirements and food allergies, other data related to mental health or neurodiversity, etc.
  • Financial data: account number, IBAN number, and other payment details.

Purposes: Service provision by Bjièn to the client (within the framework of its service and advice provision, with the exception of any processing where the client acts as the data controller) and the execution of the agreement with the client, as well as informing clients about our services and our working methods. We also process your personal data for managing our customer files, executing and following up on assignments/dossiers, administration, invoicing, and accounting.

Legal basis: Legitimate (commercial) interests of Bjièn. The explicit and informed consent of the client for the processing of any health data.

Method of collection: Directly via the client.

Personal data will only be stored for the periods provided for in the applicable legislation, such as accounting, tax, and social legislation, or for the time necessary to achieve the specific purposes.

Prospects

Bjièn collects and processes the data below from (representatives, appointees, or employees of) Bjièn’s prospects:

  • Identification data: name, first name, (professional) email address, (professional) phone number, job title, LinkedIn profile hyperlink.
  • Company data: legal form, name, company number, address of the registered office, (professional) phone number, and (professional) email address.
  • Information on where and how we met you.

Purposes: Prospecting, customer acquisition, contacting, introductory meetings, providing information to prospects, preparation of a potential agreement.

Legal basis: Legitimate (commercial) interests of Bjièn.

Method of collection: Directly via the prospect or via the website.

Personal data that Bjièn processes in the context of direct marketing is kept for a maximum of 2 years after the last contact with the client or prospect in question or after the data subject unsubscribes from the newsletter.

Applicants

Type of personal data:

  • Identification data: name, first name, email address, phone number, place of residence.
  • Information possibly provided by the applicant: personal characteristics, family composition, memberships, education and training, profession and position, function and title, and (video) images/photos.

Purposes: Administration for the recruitment and selection of candidates.

Legal basis: Legitimate (commercial) interests of Bjièn.

Method of collection: Directly via the applicant or via the website.

Bjièn is not responsible for the content and accuracy of the personal or other data you provide to it.

Transfer to third parties

If this is necessary for the realization of the stated purposes, the personal data of the client will be shared with other companies within the European Economic Area, and our hosting company Netlify and our email marketing platform ActiveCampaign which provide services to us in the context of our website and email marketing and are located outside the EEA, and that are directly or indirectly connected to Bjièn bv or with any other partner of Bjièn bv.

Bjièn bv guarantees that these recipients will take the necessary technical and organisational measures for the protection of personal data.

We are not responsible for the processing of personal data by third parties who do not process data on behalf of Bjièn, but are themselves responsible for it.

Bjièn may be obliged to provide or process your personal data on the basis of a legal obligation incumbent upon it and/or following a request from supervisory authorities, courts, or government agencies.

Right to inspection, improvement, deletion, limitation, objection and transferability of personal data

You have the right to information about the processing of your personal data. This is communicated to you via this privacy policy. You can always request additional information from us via privacy@bjien.be.

You — the data subject — have the right at all times to:

  • Inspect your personal data.
  • Have it rectified by us. You can only correct the personal data of other people if you have a signed authorisation to do so. We will contact you once this request has been executed.
  • Have it removed by us. We will only delete your data if this is possible. We can delete information requests even if the request is still ongoing. This will halt your information request.
  • Restrict its processing and object to the processing of personal data involving them based on Article 6.1 (e) or (f), including profiling based on these provisions. If you withdraw your consent, we will also delete your data in our possession where possible.
  • Obtain a copy (in a structured, standard and mechanically readable form) of their personal details and have said personal details forwarded to another company.

The exercise of your rights, as set out above, is always subject to the requirements and conditions as determined in the applicable legislation (such as the General Data Protection Regulation (GDPR)).

To exercise the above rights, you can simply send a request to Bjièn at privacy@bjien.be, in which you must identify yourself sufficiently. If Bjièn has reasons to doubt your identity, it may ask you for additional information necessary to confirm your identity. Bjièn may request a copy of your identity card to verify who is actually submitting a request, insofar as this is necessary and proportionate. You should ensure that all information or data not necessary for the verification and confirmation of your identity is blacked out or otherwise removed or made unreadable.

Complaints

We ask you to first contact us via privacy@bjien.be in case of problems. All complaints can be submitted to the Data Protection Authority at https://www.gegevensbeschermingsautoriteit.be/ – Drukpersstraat 35, 1000 Brussels – contact@apd-gba.be.
